2.         Through this application filed under Order XXIII Rule 1 CPC read with Section 151 CPC duly signed by the plaintiff, who is present in person, wherein, a request has been made to allow the plaintiff to withdraw instant suit unconditionally, as according to plaintiff, the matter has been resolved and settled between the parties. Alongwith this application, plaintiff has also filed his affidavit to this effect. Since request for unconditional withdrawal of instant suit is made by the plaintiff, therefore, there seems no impediment to grant this application. Accordingly, this application is granted and instant suit is withdrawn unconditionally alongwith pending applications.
