            Appellant and his counsel are called absent, no intimation is received. On the last date of hearing also, no one was in attendance on behalf of the appellant and the matter was adjourned in the interest of justice, whereas, counsel for the appellant was directed to satisfy this Court, as to why the order passed by this Court on 13.04.2021 has not been complied with.

Learned counsel for the respondent submits that after filing instant appeal appellant has not remained vigilant to pursue the matter, whereas, the order passed by this Court has also not been complied with. It has been further contended by the learned counsel for respondent that the impugned order does not suffer from any illegality or factual error, therefore, instant appeal is liable to be dismissed.

Since the appellant and his counsel have chosen to remain absent without any intimation and have also not been complied with the aforesaid Court’s order, therefore, this Court is left with no option, but to dismiss instant appeal on account of non-prosecution alongwith listed applications.
