            As per report furnished by S.S.P Shikarpur, the subject case on               re-investigation was recommended by the police to be cancelled under “B” Class. It is submitted by the learned counsel for petitioners that cognizance of the subject case has been taken by the concerned Magistrate and now it is pending trial before the Court having jurisdiction. If, it is so, then the petitioners may seek quashment of the proceedings or their acquittal, as the case may be in accordance with law, if so is advised to them. The quashment of FIR after cognizance of the offence/incident, by the concerned Magistrate is not permissible at law.

                        The instant constitutional petition is disposed of accordingly.
