The petitioner by making an application sought for rejection of the plaint; such application was dismissed by learned trial Court vide order dated 20.08.2020; the revision application preferred by the petitioner against dismissal of such application was also dismissed by learned Revisional Court vide order dated 23.11.2020, it is in these circumstances, the petitioner has brought the instant constitutional petition before this Court.

At the very outset, it is pointed by learned counsel for the private respondent and learned Addl.A.G Sindh that the very case is at the verge of its final disposal, therefore, no useful purpose would be served, if this constitutional petition is heard and decided on merits.

Learned counsel for the petitioner when was confronted with above, was fair enough to say that he would not press the disposal of the instant constitutional petition before this Court on merits, provided the learned trial Court is directed to dispose of the very case expeditiously preferably within one month.

Order accordingly.
