                        The appellant by way of instant criminal acquittal has impugned judgment dated 03.12.2019, passed by learned 1^st Additional Sessions Judge/MCTC, Shikarpur, whereby the private respondents have been acquitted of the offence, for which they were charged. It is the second in series. When asked, how the second criminal acquittal appeal could be maintained on same cause? It was stated by learned counsel for the appellant that the earlier one was dismissed by this Court for non prosecution and such disposal was not on merits, therefore, the second criminal acquittal appeal could be maintained on same cause. If for the sake of arguments, it is believed that the second criminal acquittal appeal on same cause could be maintained, then it is time barred miserably. Consequently, the instant criminal acquittal appeal is dismissed accordingly together with listed applications.
