                        It is contended by learned counsel for the petitioner that despite having qualified the requisite test, the petitioner has not been appointed by the respondents. By contending so, he sought for direction against the respondents to appoint the petitioner as Junior School Teacher by nullifying the appointment of anyone else made, if any.

                        Learned A.A.G Sindh by making reference to the comments filed by the Director, School Education, Hyderabad, has sought for dismissal of the instant constitutional petition by contending that the petitioner could not be appointed as marks obtained by him are less than the one who was appointed as Junior School Teacher.

                        We have considered the above arguments and perused the record.

                        Obviously, the marks obtained by the petitioner are less than the one who has been appointed, therefore, the respondents could not be directed to appoint the petitioner as Junior School Teacher by nullifying the appointment of someone else having more marks than the petitioner, by this Court in exercise of its constitutional jurisdiction, by way of instant constitutional petition, which even otherwise is hit by laches, it is dismissed accordingly.
