                        It is contended by learned counsel for the petitioner that the petitioner had qualified the requisite test, therefore, the respondents to be directed to appoint him as Police Constable.

                        Learned A.A.G Sindh while making reference to the comments filed by S.S.P, Kashmore @ Kandhkot, has sought for dismissal of the instant constitutional petition by contending that the petitioner has not qualified the requisite test for his appointment as Police Constable.

                        We have considered the above arguments and perused the record.

                        The controversy, as to whether the petitioner has qualified the requisite test for his appointment as Police Constable or otherwise, being factual could not be resolved by this Court in exercise of its constitutional jurisdiction by way of instant constitutional petition; the same being misconceived is dismissed accordingly.                                                                                                                                                               JUDGE
