                        It is case of the applicant that he with rest of the police personnel was allotted a quarter by Wapda authority at T.P.S Guddu, the electric/water and Gas connection whereof, are now being disconnected by the respondents. In these premises, he filed a civil suit, the plaint whereof was rejected by learned Senior Civil Judge, Kashmore, its rejection was reversed by learned Appellate Court with direction to learned trial Court for expeditious disposal of the suit. Subsequently, the suit with consent of the parties was transferred to another Court for its disposal according to law; the applicant apprehending unjustified disposal of his suit by learned trial Court, made an application for transfer of his suit, which was dismissed by learned District Judge, Kashmore @ Kandhkot. In these premises, the applicant has filed the instant transfer application before this Court seeking transfer of his suit to any other Court of competent jurisdiction outside of District Kashmore @ Kandhkot.

 

                        It is contended by learned counsel for the applicant that the applicant is not expecting fair trial at the hands of any of the Judge at District Kashmore at Kandhkot. By contending so, he sought for transfer of suit of the applicant to any other Judge of competent jurisdiction, outside of District Kashmore @ Kandhkot.

 

                        I have considered the above arguments and perused the record.

 

                        Nothing has been brought on file of this Court, which may suggest that the applicant being police official was actually allotted a quarter by Wapda authority at T.P.S Guddu. Be that as it may, the rejection of plaint of the applicant has been reversed by learned Appellate Court. If any direction for expeditious disposal of suit of the applicant is issued by the learned Appellate Court, then this may not be reason with the applicant to seek transfer of his case from one to other Court and then out of the district. Such practice if is allowed to continue, then it would defeat the early disposal of the suit which is prime object before learned trial Courts. Consequently, the instant transfer application being misconceived is dismissed, with no order as to costs, together with listed applications.
