                        Learned counsel for Defendant has filed proposed issues, which are taken on record. By consent following issues are framed as Court issues:-

I S S U E S

1.                  Whether the demand of Rs.49,35,594/61 raised by the Defendant is illegal and unjust and is liable to be declared as such?

 

2.                  Whether the Defendants are under an obligation to issue correct bill for electric consumed by the plaintiff?

 

3.                  Whether the Defendant has rightly calculated the plaintiff's dues as reflected in the defendant's letter dated 12th February 2007?

 

4.                  Whether the plaintiff is liable to pay Rs.9,89,242/- to the Defendant?

 

5.                  Whether the plaintiff is entitled for the payment of any compensation?

 

6.                  What should be the Decree?

 

 

 

List of witnesses, documents and commission if any within seven days. Learned counsel for the parties are required to file affidavit in evidence within one week. By consent Mr. Ismail Memon Advocate is appointed as commissioner to record the evidence of the parties. His fee would be at Rs.7000/- per witness, which will be paid by the respective parties. Learned Commissioner is required to complete the Commission within three months and return the same after expiry of this period.
