1.         Urgency application has served its purpose and the same is disposed of accordingly.

2.         Office objection is deferred for the time being.

3.         Exemption is allowed subject to all just exceptions.

4.         Learned counsel submits that petitioners are Directors of a Company which was involved in the design of Shershah Bridge which had collapsed and their names were placed in Exit Control List (E.C.L). One Director namely Naveed Zaheer has approached this court and vide its order dated 14.11.2008 in C.P.No.D-1198 of 2008, directed the respondent to delete his name from E.C.L. The name of another Project Coordinator Col.(rtd) Muhammad Siddiqui  was voluntary withdrawn by the Ministry of Interior but the name of Chief Executive Zaheer Mirza is still in the E.C.L.  Learned counsel submits that Zaheer Mirza and petitioner No.1 is very sick and he has to go for medical treatment abroad. Whereas, Khalid Mirza being a Senior Consultant Engineer has to visit other countries in connection with professional commitments. The point raised requires consideration. Issue notice to the respondent for 19.5.2009.

5.         Learned counsel submits that Zaheer Mirza is very sick and needs immediate medical attention and is seeking appointment from the relevant Doctor and Hospital abroad. We are, therefore,  pending disposal of this petition, granting him permission for one time departure from Pakistan which will be made within a period of 15 days and   from the date of departure he shall stay out of Pakistan for a maximum period of six weeks. This facility is granted subject to furnishing a surety in the sum of Rupees one million with the Nazir of this court alongwith an original passport of blood relation and the Nazir is directed to confirm that the passport does belong to a blood relation.
