Learned counsel for the appellant submits that impugned order passed in instant High Court Appeal dated 17.01.2008 has been recalled by the Hon’ble Supreme Court of Pakistan in Civil Appeals Nos.394 and 395 of 2008, vide order dated 26.02.2019, whereas, order passed in the instant High Court Appeal dated 21.09.2007 has been restored, which is required to be implemented. However, according to learned counsel, respondents are not coming forward to proceed with the matter in the instant High Court Appeal or even before the learned Single Judge on the original side in the Suit.

Let intimation notice be issued to the counsel for the respondents in the instant High Court Appeal, who shall come prepared to proceed with the appeal, failing which, appropriate order will be passed in accordance with law.

Adjourned, to be fixed after three weeks. Meanwhile, notices may also be issued to the respondents, to be served through first three modes.
