            Learned counsel for the petitioner, under instructions, submits that during pendency of instant petition and the customs reference application filed by the respondent in the instant case, respondents have auctioned subject vehicle of the petitioner, therefore, submits that instant petition has become infructuous, however, requests that petitioner may be allowed to obtain sale proceeding from the Customs Authorities in terms of section 169(5) of the Customs Act, 1969.

Accordingly, instant petition is disposed of alongwith listed application.
