Learned counsel for the petitioners, under instructions, submits that petitioners will be satisfied and will not press instant petitions, as according to learned counsel, during pendency of instant petitions provisional release of the consignments has been allowed subject to securing the disputed amount of duty and taxes before the Nazir of this Court in the shape of pay-order, whereas, order-in-original has already been passed in favour of the petitioners.

Learned counsel for the respondent does not dispute such position, however, submits that respondents intend to file an appeal against the order-in-original in the instant case.

Be that as it may, instant petitions are disposed of with the directions to the Nazir to release the disputed amount of duty and taxes deposited by the petitioners in the shape of pay-order within a period of seven days after proper verification, identification and as per rules.
