4.                     The applicant by way of instant Crl.Misc.Application under section 491 Cr.PC has sought for production of Mst.Jameela Khatoon claimed by him to be his wife, to be set free in his favour, after recording her statement, as she according to him is confined illegally by the private respondents within jurisdiction of P.S Dokri, District Larkana.

                        On being asked, why the learned Sessions Judge, having jurisdiction has not been approached for the needful in first instance?       It is stated by learned counsel for the applicant that this Court could also exercise its jurisdiction to meet with the ends of justice.

                         The reply furnished by learned counsel for the applicant is not found satisfactory. The applicant has to exhaust the alternate remedy available by the law before approaching this Court at first instance. The office is therefore directed to transmit the instant Crl.Misc.Application to learned Sessions Judge, Larkana, for its disposal according to law.
