Learned AAG,
at the very outset, has submitted that in some of the cases, the applications
have been filed belatedly. Perhaps, at the time when the cause was accrued, the
children / child were minor and they moved application(s) for exercising their
rights on reaching majority. In that case, all such applications moved by
the children of the deceased employees shall be considered, however, those
applications which were filed beyond the period of two years on reaching the
age of majority then by applying the principle as laid down in the latest
pronouncement of the Hon’ble Supreme Court in the case of Province of Sindh v. Waheed Ali and others
in C. Ps. Nos. 482-503-K of 2016,
speaking order shall be passed.
All such applications shall be
disposed of in the light of the relevant rules i.e. 11-A of the Sindh Civil
Servants (Appointment, Promotion and Transfer) Rules, 1974, and the latest
pronouncement of the Hon’ble Supreme Court in the case of Province of Sindh v. Waheed Ali and others
in C. Ps. Nos. 482-503-K of 2016.
All the petitions stand disposed
of
in the above terms along with pending applications, if any.
