                        At the very outset it is stated by learned counsel for the applicant that he would not press disposal of the instant bail application on merit if the applicant is permitted to repeat the same before learned trial Court after recording evidence of complainant.

                        The proposal so advanced by learned counsel for the applicant is not opposed by the learned A.P.G for the State and learned counsel for the complainant. 

                        In view of the above, instant bail application is disposed of as not pressed, with permission to the applicant to repeat the same after recording of  evidence of the complainant, which is expected to be recorded preferably within one month. Needless to say that if such application is repeated by the applicant then it would be decided by learned trial Court strictly on merits.
