The
applicant claims to be in possession in pursuance of an alleged waqf
deed executed by the attorney of the alleged owners. The case was remanded to the
trial Court whereby additional issues were framed.
No
indulgence as such is required since it is only a remand order whereby trial
Court was directed to adjudicate the case including the additional issues. The
applicant, however, is at liberty to move an application for the correction of
issue No.3 as he claims that instead of waqf, gift was typed
erroneously. Let such application be filed before the 2nd Additional
District Judge who may pass appropriate orders after hearing the parties.
In
addition to the three additional issues, an issue as to whether the proceedings
are barred by res judicata may also be framed by the trial Court as additional
issue No.4. The trial Court shall proceed with the matter expeditiously and
dispose it of preferably within four months. Revision, with the consent of
learned counsel for the applicant, is disposed of along with listed
applications.
