Statements have been filed by respondents No.3 to 10, taken on record, copies supplied to counsel for the petitioner. Petitioner has business dispute with private respondents however when the petitioner approached the area police to lodge an FIR, the same was denied, on which he moved an application before learned Justice of Peace/Sessions Judge Naushahro Feroze in Cr.Misc.Application No.1539/2017. The counsel for the petitioner submits that the order has already been passed by Justice of Peace on 15.8.2017 where SHO Police Station Naushahro Feroze was directed to take statement of the petitioner and incorporate it in 154 Cr.P.C and if a cognizable offence is made out, and then act in accordance with law. Learned counsel for the petitioner submits that he went to the concerned SHO who even after the said order refused to record his statement and to act thereon. Learned AAG is present and affirms that if petitioner approaches the Police Station and gives his statement which will be recorded u/s 154 Cr.P.C and if a cognizable offence is made out an appropriate FIR would be lodged. With these undertakings, the counsel for the petitioner is satisfied and does not press the instant petition which is accordingly disposed of in the above terms. Copy of this order be provided to the concerned SHO.
