04.2.2016, passed following order:
“On 24.2.2014, when this case came up
before this court none was present for the applicant, therefore, the case was
adjourned. Thereafter on many occasions, this case perhaps stands discharged.
Today case is fixed, however, neither the parties nor parties counsel are in
attendance, therefore the case is adjourned, however, with a note of caution
that if learned counsel for the applicant fails to appear and proceed with the
case on the next date, then some appropriate order will be passed as this
matter pertains to year 2005 and requires quick disposal. To
come u on 10.3.2016.
Today
none is present on behalf of any of the parties, whilest
the above order made it clear that if none is present on behalf of the
applicant on the next date of hearing, this matter which pertains to year 2005
may be disposed of with appropriate order. While it is a fit case for
dismissing the instant revision on account of non-prosecution, I have taken the
opportunity of going through the concurrent findings given by the trial court
as well as appellate court and looking at the matter I do not find any window
of opportunity to intervene in these concurrent findings. The revision
application is accordingly dismissed.
