Mr. Riaz Ali Shaikh Advocate files vakalatnama on behalf of private respondents which is taken
on record. Statements have been filed by respondents No.2, 3, 4 and 5, taken on
record, copies supplied to the learned counsel for the petitioner. Case of the
petitioner is that his father is the real brother of the private respondents
No.6 and 7 and after the demise of the petitioner’s grand father when his
father claimed his legitimate share in the lands from the private respondents,
with the alleged collusion of the area police, the petitioner is harassed to
the extent that he was taken to Police Station and after payment of moneys was
released. These allegations are denied by the area police as well as learned
AAG who states that the police is acting neutral in
this private dispute and not causing any harassment to the petitioner or his
family. Learned counsel for the private respondents submits that the private
respondents are not causing any harassment to the petitioner and his family
either and whatever civil dispute they have, they are willing to resolve it in
accordance with law. Petitioner counsel is satisfied if an order is passed to
the effect that the private respondents be called upon
to act strictly in accordance with law and the civil dispute be resolved through
appropriate forum. Order accordingly. The area police to act strictly neutral
and cause no harassment to the petitioner and his family and provide protection
as and when needed. The petition stands disposed of in the above terms.
