Comprehensive parawise comments has been filed by Ziadullah Leghari Divisional Forest Officer Khairpur wherefrom it appears that forest department has taken action against the petitioners for purportedly encroaching uponthe forest land. Copy of the criminal case No. 281/2009 is also appended with their parawise comments in which present petitioner has been mentioned as accused and as per learned A.A.G these petitioners have been convicted in trial pertaining to F.I.R No. 96/2009 of Police Station Tando Masti Khan. All these facts have not been mentioned in present petition which shows that the present petition has been filed by concealing the material facts which further shows that petitioners have come to the Court with unclean hands, therefore petitioners disentitle themselves from any relief. Consequently this petition is dismissed with cost of Rs.10,000/- which should be paid by the petitioners within one week in the account of dispensary funds of this Court and receipt of which shall be deposited by the petitioners with the Accountant of this Court.
