                      Accused Fida Hussain was admitted to interim pre-arrest bail by this Court, such concession was recalled on account of his absence without intimation, consequently notice to his surety was issued. In pursuant to service of notice, surety appeared and filed reply of the notice.

                      It is stated by counsel for the surety that the accused could not attend this Court due to some unavoidable circumstances and after obtaining pre-arrest bail from this court and is in attendance continuously. By contending so, he requests for recalling of notice.

                      Learned APG has recorded no objection for recalling of notice.

                      I have considered the arguments and perused the record.

                      Admittedly after obtaining pre-arrest bail, accused Fida Hussain has attended trial court as is evident from case diary dated 25.4.2018. In that situation case for recalling of notice against surety is made out. Consequently it is recalled.
