                      It is alleged that present applicants along with rest of the culprits formed an unlawful assembly in furtherance of their common objection fired at injured Pervaiz Ali and Saeed Ahmed with intention to commit their murder. For that they were booked in the preset case. They by way of filing application u/s 498-A Cr. PC sought for pre-arrest before trial court, which was declined. They now sought for their release on bail from this Court by way of filing instant application u/s 498-A Cr. PC.

                      I have considered the arguments and perused the record.

                      Presently complainant Mumtaz and PWs Saeed and Pervaiz Ali by filing their affidavit have raised no objection to the grant of bail to the applicants, by stating that they have compounded the offence with them at the instance of their Nekmard. The offence does not fall within prohibitory clause of Section 497 Cr.PC and is compounded by the complainant and injured witnesses, could not be lost sight of.

                      Learned DPG also recorded no objection to the grant of pre-arrest bail.

                      Interim pre-arrest bail already granted to applicants vide order dated 27.5.2016 is confirmed on same terms and conditions.
