                      The applicant by way of instant Cr. Misc. Application u.s 561-A Cr.PC has impugned order dated 14.2.2018 of learned Ist. Additional Sessions Judge/Ex-Officio Justice of Peace Nausheroferoz, whereby his application u/s 22-A & B Cr.PC for issuance of direction against the SHO PS Halani to record his FIR against proposed accused was dismissed.

                      At the very outset it is stated by learned counsel for applicant that he would not press the disposal of instant Cr. Misc. Application before this court on its merits, if the applicant is permitted to exhaust his remedy u/s 200 Cr.PC before the court having jurisdiction.

                      The proposal is not opposed by learned DPG.

                      In view of above, the instant Cr. Misc. Application is disposed of as not pressed with permission to applicant to exhaust his remedy u/s 200 Cr.PC before the court having jurisdiction.
