                        By way of instant Crl.Misc.Applicatoin, the applicant has impugned an order dated 01.08.2017, passed by leaned 6^th Civil Judge & Judicial Magistrate, Shikarpur, whereby  he has refused to cancel FIR Crime No.08/2017, u/s. 324, 504, 34 PPC of P.S New Faujdari, Shikarpur, under “B” class.

                        At the very outset, it is stated by learned counsel for the applicants that he would not press disposal of instant application on merits, if the applicants are permitted to seek their premature acquittal by way of filing an application u/s.265-K Cr.PC before learned trial Court.

                        Learned A.P.G did not oppose to above said proposal.

                        In view of above, the instant application u/s.561-A Cr.PC is dismissed as not pressed, with permission to the applicants to seek their premature acquittal from the learned trial Court by way of filing an application u/s.265-K Cr.PC, the same on filing would be decided by learned trial Court within 30 days, strictly on its merits.
