Mr. Liaquat Hussain is present and seeks discharge of Vakalatnama of Zahid F. Ebrahim from the instant suit as well as connected suit No.264 of 2005 as he has been superseded. Office is accordingly directed to remove his name from the cause list as well as from the file cover.

The Court has been informed that earlier order of this Court dated 26.07.2018 is impugned in HCA No.296 of 2018 where trial Court is restrained from passing any order with regard to the application for recording of evidence of the respondent (plaintiff) through his attorney.

While through the instant application a request is made for appointment of the commissioner, however this matter was already heard on which the impugned order was passed when my learned brother was pleased to observe that the evidence be recorded in the Court which is subjudice in the appeal. In these circumstances, it would be prudent to wait to the outcome of above referred High Court Appeal. The matter to come up thereafter.
