Learned counsel for the applicant submits that respondent No. 3 intends to lodge second FIR, as he has already lodged FIR bearing crime No. 31/2018 of PS Darya Khan Marri regarding same incident, but in view of unreported human right case bearing No.10842-P of 2018 of Honourable Supreme Court of Pakistan regarding Mst Sughran Bibi v The State, there is no provision of lodging second FIR.

Learned DPG has conceded the arguments of learned counsel for the applicant and states that in view of the unreported human right case of Honourable Supreme Court of Pakistan cited supra, there is no provision of lodging second FIR.

In view of the unreported case of Honourable Supreme Court of Pakistan cited supra, instant criminal miscellaneous application is allowed and resultantly impugned order dated: 09.06.2018 passed by learned 3^rd Additional Sessions Judge/Ex-Officio Justice of Peace Nausheroferoz is set-aside. However respondent No. 3 is at liberty to file direct complaint, if he chooses so.
