The appellant on having been found guilty for offence punishable u/s 302 (b PPC for committing death of Mst. Hakimzadi was convicted sentenced to undergo R.I for ten year with fine of Rs. 200,000/- (Two Lac) to the legal heirs of said deceased which is against the spirit of law simply for the reason that the moment charge of murder for an offence punishable u/s 302 (b) PPC is proved, then accused is liable to be awarded death penalty or imprisonment for life. In these circumstance a notice be issued against the appellant to show cause as to why the conviction of ten years which is awarded to him for offence punishable u/s 302(b)PPC may not be enhanced to imprisonment for life or death.

Office is direct to register the notice as suo-moto revision and tag it with main appeal.
