Mr. Tariq Qureshi, Advocate requests for adjournment on the ground that Mr. Fazal-e-Ghani Khan, Advocate is busy before another bench.

This application is of the year 2003, on which interim order was obtained on 10.7.2003 whereby the defendants were prohibited from encashing the bank guarantee.

Learned counsel for the defendant No.1 states that defendant No.1 has filed its counter affidavit and interim order is acting prejudicially against it.  He strongly opposed the application and requested that either interim order be recalled and in case such is not done, a fixed date may be given.

Mr. Haleem Siddiqui, learned counsel for the defendant No.2 states that the suit is not maintainable for the reason that the court legs territorial jurisdiction.

Be that as it may, as a final chance the matter is adjourned to 27.5.2009. In case the plaintiff counsel is not available on the next date to argue this application, the interim order passed earlier will stand recalled.
