is an appeal filed against the order dated 25.11.2014 passed by respondent No.2,
whereby the appellant’s candidature for the post of Assistant Draftsman (BS-18)
was rejected, on the ground of lack of the evidence about the requisite experience.
On 30.10.2017 a detailed order was passed by this Court, inter alia, in which
respondents were directed to place on record the credential of those candidates
who were appointed against the seats reserved for the other Provinces relating
to the same post. The observation in the last order about, inter alia, legislative
drafting/drafting of statutes, rules and notifications is of relevance.
2. A close
examination of the record produced today by the respondents and after hearing
the parties at length, the following order is passed.
3. Since the
appellant undisputedly has passed his written test and also has requisite
academic qualification, the peculiar facts and circumstances warrant and justify
that he should be called for an interview/viva-voice. The learned Assistant Attorney General
alongwith Mr. Muhammad Iqbal Arain the Deputy Director of FPSC, have stated
that in the interview the appellant has to file his documents and credential as
mentioned in the subject Consolidated Advertisement No.10/2013. This being a uniform
criteria, obviously appellant can not deviate from that. Hence, the appellant
will be called for an interview by the respondents as per prescribed procedure and
his case will be considered by applying the same criteria as was done in the
case of other three candidates and particularly M/S Abid Ali and Chand Ashraf,
hailing from KPK and Punjab respectively.
4. Accordingly,
the orders/decisions impugned, passed by Respondents (FPSC), are set aside and
present appeal is disposed of in the above terms.
