On perusal of record, it appears that petitioner was admittedly retired from services on 11.03.1999 and has collected all his pensionary benefits. Cop of the pension payment order is enclosed alongwith comments filed on behalf of respondents Nos.4 to 6 as annexure “A”. Interim order passed in this petition on 05.12.2014 was vacated by order dated 27.02.2017. Detailed and comprehensive comments has already been filed on 06.02.2017 by the respondents Nos.4 to 6, which are available on record. In their comments it is stated that the petitioner has to retain the subject premises only for six months after his retirement as per office Memo No.10/52/95-R.2(pt) dated 01.06.1999.

In view of above circumstances, instant petition is hereby dismissed alongwith pending applications. However, applicant/intervenor may approach to the concerned section/department for obtaining possession of the subject accommodation, if same has been allotted to him.
