learned counsel for the petitioners sealing order was passed by the respondent No.1 on 07.092017. Against that order present petition was
filed and by order dated 22.11.2017 petitioners were directed to file Appeal
under section 16 of SBCA Ordinance in respect of
subject property and the Appellate Authority was directed to dispose of the
matter in accordance with law after giving opportunity of being heard to all
concerned within a period of one month’s time from receipt of the order. Per
learned counsel for the petitioners, the petitioners filed such Appeal before
the Secretary, Local Government and Housing Town Planning Department,
Government of Sindh alongwith of the same is available as annexure “P/1” with
instant application. Learned counsel for the respondent SBCA
submits that in fact the Appeal is to be filed before the Chief Executive of
Respondent No.1 therefore,
said appeal has been sent by the Secretary Local Government to the respondent No.1. Let report be called from the Secretary, Local
Government as to whether any such appeal has been filed, so also fate of such
appeal, which shall be submitted within seven days’ time.
In the wake of the
above, the Appeal filed by the petitioners, which is pending either before
Secretary Local Government and Housing Town Planning Department, Government of
Sindh or Chief Executive, Sindh Building Control Authority, shall be decided
within fifteen days’ time from receipt of this order.
Application stands
disposed of accordingly.
