Through this application applicant/surety seeks return of
surety documents/amount. Learned counsel for the applicant/surety submits that
protective bail was granted to the both applicants/accused Muhammad Saleem and Hadi Bux by this Court vide order dated 09.05.2018. Thereafter, both
applicants/accused approached to the District and Sessions Judge, Malir,
Karachi by filing Bail Application No.797/2018 and
interim pre-arrest bail was granted to them on 22.05.2018, which was confirmed
by the learned Ist Additional Sessions Judge, Malir,
Karachi vide order dated 22.05.2018. Certified copy of said order is available
on record. Learned Additional P. G. Sindh has given his no objection for grant
of instant application.
In view of above
circumstances, application is allowed and the Nazir
of this Court is directed to return surety documents/amount to the Applicant/surety
on proper identification, verification and after obtaining valid receipt.
