3&4)    Learned counsel for the petitioner contends that the petitioner is owner of Flat No.4, First Floor, Habib Mansion, Gali No.9, on Plot No.AM-1/23, Burns Road, Karachi. Learned counsel further contends that respondents No.4, 5 and 6 despite sealing order issued by the respondents No.2 and 3 (copy of the same is available as annexure “B” at page-59 with MoP) are trying to raise constructions of a hotel for commercial basis illegally and unauthorizedly. Petitioner has lodged complaints to different authorities for such illegal construction, which are available as annexures “A/1 and A/2” with MoP but till this date no action has been taken to stop the illegal construction on the subject plot/building.

 

Issue notice to the respondents for 04.09.2018. In the meantime, respondents No.2 and 3 are directed to take appropriate legal action against the respondents No.4, 5 and 6 and other persons who are raising illegal construction on the subject plot/building contrary to approved building plan and Karachi Buildings and Town Planning Regulations, 2002. Respondents No.2 and 3 are further directed to take concrete steps to restrain the respondents No.4, 5 and 6 and other persons from raising illegal construction on the subject plot/property and submit comprehensive compliance report to this Court on or before next date of hearing. Respondent No.7 is directed to provide requisite police force to the officials of the SBCA at the time of taking action to stop illegal construction on the subject plot/property as and when required.

 

Copy of this order be communicated to the respondents No.2 and 3 in ordinary course and through facsimile for information and compliance.
