3&4) Per learned counsel for the petitioners, several other petitions on the similar and identical points are already pending in this Court and he has referred to order passed on 02.11.2016 in C.P. No.D-5964 of 2016 available as annexure “E/1” at page-67 with MoP. Per learned counsel for the petitioners, KMC has issued notice for recovery in that petition for huge amount and matter was stayed by this Court and direction was given for not taking any coercive action against the petitioner in that petition. Learned counsel for the petitioners submits that same treatment may be given to the present petitioner as according to learned counsel for petitioners, respondent No.1 has issued notice for recovery of utility charges, which is available as annexure “C” at page-47 with MoP. Per learned counsel petitioners have already paid property tax and other charges and has referred to annexures “B/1 and B/2” photocopies of paid utility charges to different authorities. Issue notice to the respondents and Advocate General Sindh for 18.01.2018. Till next date of hearing, no coercive action should be taken against the petitioners pursuant to impugned notices.

To come up alongwith C.P. No.D-5964/2016 and other connected petitions.
