Mr. Ghulam Murtaza, Advocate for Petitioner alongwith Petitioner, Legal Heirs, namely, Mrs.Fauzieh Merchant, Miss Sara Mahmood, Miss Saroor Fatima and witness Muhammad Murtaza Rafique.

      This application for grant of Letter of Administration / Succession Certificate has been filed by the petitioner Mrs. Zeenat Mahmood Allarakhia widow of the deceased Mahmood Sultan Allarakhia, who expired on 10.01.2008 leaving behind the legal heirs as mentioned in Para 2 of the petition and properties mentioned in Para 5 of the petition.

      Notice of this succession application was published in Daily Jang Karachi on its issue dated 19.3.2009, but no objection whatsoever nature has been filed from any quarter.

      The daughters of the deceased, who are present in Court, have given their no objection for grant of Letter of Administration / Succession Certificate in favour of their mother the petitioner. This fact has been mentioned in their affidavits of no objection.

      The witness, who is also present in Court, has stated that the deceased was his maternal uncle and he knows the family of deceased and particulars given in the application for grant of Letter of Administration / Succession Certificate and there is no other legal heirs of the deceased. This fact has also been mentioned in his affidavit of no objection.

      In view of the above, there appears to be no impediment to grant of Letter of Administration / Succession Certificate in favour of the petitioner, hence this petition is allowed as prayed. Letter of Administration / Succession Certificate be issued in favour of the petitioner as per rules.

      This S.M.A. is disposed of accordingly.
