                  Petitioner and his counsel called absent. No intimation received. Instant petition was filed on 31.12.2013 whereby the petitioner has alleged that a housing scheme is being constructed over State land and has prayed that private respondents may be restrained from raising construction and official respondents may be directed to take action against them in accordance with law. However, after having filed the instant petition the petitioner and his counsel has not remained vigilant to proceed with the matter. Record reveals that the allegations as contained in the instant petition are not dully supported by any material except some Newspaper clips which prima-facie can not be considered as lawful basis to support allegations against some private respondents in relation to construction work of housing project. We may further observe that there is relevant department of Sindh Building Control authority, where such complaints can be filed, whereas, it is the duty of Sindh Building Control Authority and other government departments who are responsible to regulate and supervise the construction of any housing project, and in case of any violation, to take necessary action in accordance with law.

                  Accordingly, instant petition is dismissed for non-prosecution, however, concerned respondents are directed to ensure that no housing scheme/project will be allowed to raise construction except after completion of all codel formalities and approval of its building plan, in accordance with law.
