Petitioner and his counsel called absent. No intimation received. Instant petition was filed on 16.10.2012 whereby petitioner has prayed for direction of this court to respondents to promote petitioner from the post of Junior School Teacher to the post of High School Teacher as per his seniority However, after having filed instant petition, petitioner and his counsel has not remained vigilant to proceed with the matter. Whereas, learned AAG submits that instead of filing instant petition, petitioner should have approached the relevant department for redressal of his grievance in accordance with law. Contention of learned AAG appears to be correct. Accordingly, instant petition is pending since 2013 without any useful progress, whereas, petitioner and his counsel has not come forward to proceed with the matter.
Accordingly, instant petition is dismissed for non-prosecution. However, if petitioner still feels aggrieved by any action on the part of official respondents regarding his promotion he will be at liberty to approach the relevant authority as per rules provided under the law who shall consider the request of the petitioner strictly in accordance with law as per rules after providing opportunity of being heard to the petitioner.
