Mr. Aijaz Ali Jarwar holding brief on behalf of Mr. Haji Shamsuddin Rajpar seeks adjournment as the later learned counsel is out of station, however pleads no instruction. Instant petition is pending since 18.1.2011. Whereas, petitioner has sought direction of this court that Railway department may be restrained from dispossessing the petitioner or removing the quarter of the petitioner from the lands of Railway department. Learned counsel who is representing the Railway department submits that petitioner is encroacher who has illegally constructed katcha pakka house over the land of railway department. In pursuance of Honourable Supreme court suo moto notice, Railway department by following legal course may remove such encroachment from railway land in accordance with law.
Accordingly, instant petition is dismissed with direction to the respondents that if the petitioner is fond to be encroacher over the railway land such encroachment may be removed and petitioner may be dispossessed from railway land by following legal course, which are available to the respondents strictly in accordance with law.
