Pursuant
to Court notice, Aijaz Ahmed Channa,
XEN SEPCO, Rohri, shown appearance and submits that
petitioners were misusing the electricity connection and exceeded their load
capacity which was sanctioned, therefore, their meters as well as transformer
have been removed.
From
perusal of record, it appears that no legal course has been adopted by the
respondents while taking such extreme action against the petitioners as no
notice was issued as required under the law to the petitioners, no detection
bill has been made before removing the maters and transformer which were
installed by the SEPCO.
Learned
Counsel for the petitioners submits that the respondents may be directed to
ascertain the exceeding load capacity of the petitioners whereafter
meters may be installed and if there is amount required to be paid in excess in
view of the load capacity, demand notice may be issued by the respondents which
will be paid by the petitioners and such exercise shall be completed within a
period of one week in accordance with law, as the petitioners are without
electricity.
Let
the needful be done by the respondents within a period of one week in
accordance with law, whereafter compliance report may
be submitted through Additional
Registrar of this Court within two weeks.
Petition
stands disposed of along with listed application in the above terms.
