Petitioner and his counsel called
absent, no intimation received. Through instant petition, the petitioner has
prayed that the respondents may be restrained from demolishing the construction
raised by the petitioner on the Railway land, in view of the fact the
petitioner has filed an application seeking for lease of subject-property.
Notices
were issued, pursuant to which Mr. Muhammad Imran Khan advocate for Railway has
shown appearance and submits that the petitioner has no locus standi and was an encroacher of Railway land, which has
been removed pursuant to orders of Hon'ble Supreme Court, therefore, instant
petition has otherwise become infructuous.
It
appears that after filing instant petition on 05.12.2012, the petitioner has
not come forward to proceed with the matter, who
appears to have lost interest. Moreover, in view of the comments filed by the
respondents and the statement of learned counsel that the encroachment has been
removed, instant petition otherwise has become infructuous, which is hereby
dismissed.
