Petitioner
and his counsel called absent, no intimation received. Instant petition was
filed on 13.11.2012, whereby petitioner has prayed that respondents No.5, 7
& 8 may be directed to carry-out the survey work for demarcation of Kety
Unar and Drigh Forest after verifying the relevant record and by charging
expenses specifically within a reasonable period.
Comments
have been filed on behalf of official respondents, wherein it has been stated
that the demarcation of the lands is not the function of the survey department
and such request can be entertained by the concerned Mukhtiarkar, who is
authorized under Section 67-A of Amended Sindh Land Revenue Rules, 1968.
Petitioner and his Counsel after having filed instant petition have not
proceeded with the matter with due diligence, whereas, proper mechanism has
been given under Sindh Land Revenue and relevant rules for the purpose of
seeking demarcation of land. Accordingly, instant petition is dismissed for
non-prosecution, however the petitioner may be at liberty to approach the
relevant authorities for necessary demarcation of the land in accordance with
law and relevant rules.
