Mr. Shafique Ahmad Khan Laghari, advocate for the applicants a/w applicants.

1.                 Urgency is granted.

1,3. & 4.       It is inter alia contended by the learned counsel for the applicants that the applicants are innocent who have been falsely involved in Crime No. 43/2015, of P.S Jhangro, U/S 395, 506/2, 147, 148, 149 and 7 ATA. He further contended that there is a dispute between the applicant and complainant and such civil litigation over the landed property is pending, before the Civil Court. Prior to this, the applicants had filed protective bail application before this court  and they had been granted protective bail in the sum of Rs.25,000/- each and P.R bond in the like. They surrendered themselves before the trial court, wherefrom they were granted interim pre arrest bail and their bail application was fixed for hearing. In the meanwhile second F.I.R was registered by the complainant Gul Hassan being Crime No. 01/2016 U/S 395, 506/2, 147, 148, 149, 337-AI, 337-H-II, 384 P.P.C and 7 ATA at P.S Jhangro at the instance of complainant of this case and the complainants of both the cases are near relatives. Second F.I.R has been lodged with malafide intention to get arrest the applicants for humiliation and disgracing them, hence they remained absent on the date of hearing and their application for pre-arrest bail was dismissed for non-prosecution. Per learned counsel, the applicants are willing to surrender before the trial court to join the investigation and to obtain bail before arrest, hence pray that the protective bail may be granted to the applicants enabling them to surrender before the trial court

Without touching the merits of the case, the applicants are granted protective bail for seven days from today subject to furnishing their solvent surety in the sum of Rs.35,000/- each with P.R bond in the like amount to the satisfaction of the learned I/C Additional Registrar of this court enabling them to surrender before the learned trial court.

This order shall seize to have its effect on 03.04.2016 or whenever the applicants will surrender themselves before the learned trial court whichever is earlier.

Instant criminal bail application stands disposed of.
