Petitioner and his counsel called absent, no intimation received. Instant petition was filed on 31.10.2011, whereby, the petitioners have sought quashment of FIR No.357/2011 registered at PS, Ubauro, however, after filing instant petition, it appears that that the petitioner and his counsel have not remained vigilant to proceed with the matter, which is pending since 2011, and has been fixed in Court after lapse of four years.

On 01.11.2011 order was passed by this Court restraining the IO not to challan the matter in Court. We are not inclined to keep this matter pending without any useful progress or to continue the stay, which was granted ex parte on 01.11.2011, however, record shows that such interim order is still in force as the same has not been recalled.

Accordingly, we dismiss instant petition for non-prosecution along with listed applications.
