Mr. Shafique Ahmed Leghari, State Counsel along with ASI Shahbaz Shar, ASI Police Station, Mirwah.

Petitioner and his Counsel called absent, no intimation received. Instant petition was filed on 19.8.2013 whereby petitioner has sought quashment of F.I.R No. 149 of 2013 registered at police station, Thari Mirwah, District Khairpur under section 380 & 506/2 PPC for being false and fabricated. However, record shows that after having filed instant petition, petitioner and his Counsel did not remain vigilant to proceed with the matter, which is pending since 2013 without any useful progress, wherein, no restraining order has been passed. Today statement along with annexures has been filed on behalf of SHO Police station, Thari Mirwah, which is taken on record, wherein it has been stated that the aforesaid F.I.R has duly been challaned before the learned trial Court, which is pending trial. It appears that in view of herein above facts and circumstances, the petitioner has lost interest to proceed with the matter, which is accordingly dismissed for non-prosecution along with listed application.
