Petitioner and his Counsel called absent, no intimation received. Instant petition was filed on 05.7.2013, whereby petitioner has prayed for quashment of F.I.R No.07/2013 U/s 395 PPC registered at police station, Gemro, District Ghotki. Today ASI Rafique Ahmed has shown appearance and filed statement on behalf of S.H.O police station, Gemro and submits that report U/s 173, Cr.P.C for disposal of the case was submitted under “C” class before the concerned Magistrate, however he has taken cognizance vide order dated 15.7.2013.

In view of hereinabove facts and circumstances, the petitioner appears to have lost interest to proceed with the matter, which is accordingly dismissed for non-prosecution along with listed application.
