Petitioner, who is appearing in person, is called absent, no intimation received. Instant petition was filed on 12.09.2013, whereby the petitioner seeks enforcement of some contractual obligation in respect of some outstanding amount. Learned AAG has raised an objection with regard to maintainability of instant petition. We are also of the opinion that contractual obligation cannot be enforced by filing petition, as the same requires evidence and may involve disputed facts. Moreover, the petitioner has not remained vigilant to proceed with the instant petition, which is pending since 2013 without any useful progress.

Accordingly, instant petition is dismissed for non-prosecution along with listed application.
