Petitioner and his Counsel called absent, no intimation received. Instant petition was filed on 06.8.2013, whereby the petitioner has prayed that respondents may be directed to make payment of outstanding amount to the petitioner in respect of sale consideration of Gunwar. After having filed instant petition, it appears that petitioner and his Counsel have not remained vigilant to proceed with the matter, whereas, claim of the petitioner seeking release of some outstanding amount against respondents appears to be misconceived, as it pertains to contractual obligations between the parties and the matter involved disputed facts and recording of evidence. Accordingly, instant petition is pending since 2013 without any useful progress, which is hereby dismissed for non-prosecution.
