                        Petitioner called absent, no intimation received.  Instant petition was filed on 22.3.2013, whereby the petitioner has leveled allegation against respondents No.1 to 5, who according to petitioner have illegally cut old Sheesham (Talli) Trees from both sides of Mirwah Canal from Kot upto Timoohn as well as other minors of District Khairpur from different places, hence caused huge financial loss to the Irrigation Department. However, record shows that after having filed instant petition, petitioner has never appeared before this Court during these years, who has either lost interest in the matter or could not substantiate the allegations as leveled in the instant petition.  Moreover, no material has been placed on record to substantiate such allegations.

                        Accordingly instant petition is dismissed for non-prosecution along with listed application. However, since a matter of public importance has been brought to the notice of this Court, we may observe that it is the duty of the Irrigation as well as Forest Departments, Government of Sindh to ensure that Trees planted alongside the banks of irrigation Canals and the minors as well as on the lands of the Forest department particularly in Katcha Area, shall be preserved and in case there is any illegal cutting of said trees or theft, strict legal action is required to be taken against such delinquent persons in accordance with law.

                        All necessary steps shall be taken to increase the plantation as well as to meet the requirement of law and to preserved environment which has already been polluted and has adversely affected the seasons, as there are hardly any rains in the province of Sindh for the last several years. Let copy of this order be communicated to both the Secretaries of Irrigation as well as Forest Departments, Government of Sindh, Karachi for information and compliance. Copy of this order may also be provided to learned Addl: A.G cover in hand for onward transmission to the concerned Secretaries.
