Through instant petition, the petitioners have impugned the recruitment process of Junior Physical Teachers/Instructors for the year, 2012 in Education Department, District Naushahro Feroze and have alleged that the candidates who did not qualify, have been given appointed by ignoring the petitioners.

Notices were issued pursuant to which, comments have been filed on behalf of respondent No.4, wherein the claim of the petitioners has been seriously disputed and the allegations have been denied. Learned Asstt: A.G has referred to Para No.5 of the comments filed on behalf of respondent No.4 and submits that the petitioners have not appeared in the written test, whereas, they have filed instant petition with malafide intention by merely raising certain allegations. Per learned Asstt: A.G, the entire recruitment process was transparent and the appointments have been given strictly on merits.

While confronted with such position, learned Counsel for the petitioners submits that petitioners are not coming forward to issue instructions, therefore, he is not in a position to controvert the same. Accordingly, instant petition being devoid of any merits, which otherwise involves disputed facts, is hereby dismissed.
